Rustenburg Water — Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Rustenburg Water Alerts mobile application and the website rustenburgwater.org (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Quick summary:
We provide general information and notifications about municipal water services. We try to be accurate and timely, but outages and restorations can change. Do not use the app for emergencies. Your location helps us show relevant alerts. Be respectful, don’t misuse the Service, and understand we provide no warranties and have limited liability as set out below.
1) Who we are“Rustenburg Water Alerts”, “we”, “us”, or “our” refers to the operator of the Service on behalf of Rustenburg Local Municipality.

2) Eligibility & accountsYou must be 13 years or older to use the Service (or have guardian consent where required by law).Some features may require you to create an account or provide contact details. You agree to provide accurate information and keep it updated.You are responsible for keeping your device and any login credentials secure.
3) What the Service provides (and what it does not)The Service provides general municipal water updates, including outages, maintenance, restorations, tanker deployments, alerts, and news.Information may come from municipal operations, telemetry, and other systems. Times and statuses can changedue to operational conditions.Not an emergency service: If life or property is at risk, call emergency services or the official municipal call centre. Do not rely on the app for urgent assistance.
4) Location, notifications & preferencesWith your permission, we may access your device location to show nearby alerts and to send geo-targeted notifications.You can change or revoke location and notification permissions in your device settings at any time.Standard data/airtime charges from your network provider may apply.
5) Acceptable useYou agree not to:Interfere with, disrupt, or overload the Service or its infrastructure.Upload or transmit content that is unlawful, abusive, defamatory, or infringes others’ rights.Attempt to reverse-engineer, scrape, or bypass security.
Use the Service while driving or where doing so would be unsafe or unlawful.We may suspend or terminate access for violations (see §12).
6) User submissions & feedbackIf you submit content (e.g., messages in live chat, feedback, or suggestions), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content to operate and improve the Service. Do not submit confidential or proprietary information you do not wish to share.
7) Accuracy, availability & changesWe strive for accuracy but do not guarantee the correctness, completeness, or timeliness of any information.The Service may be unavailable from time to time for maintenance, upgrades, or factors outside our control.We may change, add, or remove features at any time.
8) Third-party services & linksThe Service may rely on or link to third-party services (e.g., app stores, maps, analytics, push notification providers). Your use of those services may be governed by their own terms and policies.
We are not responsible for third-party content or services.
9) Intellectual propertyAll logos, names, graphics, interfaces, and content are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the app and website for non-commercial purposesin accordance with these Terms.
10) FeesThe app is currently free to download and use. We may introduce paid features in the future with notice and updated terms. Your mobile network charges still apply.
11) DisclaimersTo the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind (express or implied), including fitness for a particular purpose, reliability, availability, or accuracy. Information in the app is general information and should not be relied upon as professional, technical, or emergency advice.
12) Limitation of liabilityTo the fullest extent permitted by law, we and our employees, contractors, suppliers, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, loss of goodwill, or service interruptions arising from or related to your use of the Service. Our total aggregate liability to you for all claims shall not exceed the amount you paid to us (if any) for the Service in the 12 months preceding the claim.
13) IndemnityYou agree to indemnify and hold harmless us and our personnel from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms.
14) PrivacyYour use of the Service is also governed by our Privacy Policy (available on the website). Please review it to understand how we collect and process personal data, including location and notification preferences.
15) Changes to these TermsWe may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Your continued use after changes means you accept the revised Terms.
16) Governing law & disputesThese Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of South African courts.
If a court finds any provision unenforceable, the remainder remains in effect.
